These Terms of Use govern access to and use of the vektorfitness.com.br website, the Vektor Fitness apps (Vektor Fitness Pulse, Jump and Speed) and the devices sold under the Vektor Fitness brand, all owned by JF Tecnologia e Soluções LTDA (CNPJ 57.189.628/0001-02, with headquarters in Santa Rita do Sapucaí — MG (Vale da Eletrônica), Brasil). By using our services you state that you have read, understood and fully accept these Terms.
1. Definitions
- Platform: the Vektor Fitness website, apps, devices and API.
- Gym: a legal entity that contracts Vektor Fitness to use the Platform on its premises.
- User: a member, instructor, manager or anyone who uses the Platform.
- Account: individual credentials to access the Vektor Fitness apps.
2. Registration and account
To use the Platform, the User must create an Account with accurate, current and complete data. The User is solely responsible for credential confidentiality and for all activity in their Account. In case of misuse or suspected breach, the User must notify Vektor Fitness support immediately.
3. Permitted use
- Use the Platform only for lawful purposes and per these Terms.
- Do not access restricted areas, bypass security or reverse-engineer the software.
- Do not submit offensive, discriminatory, fraudulent or third-party-rights-infringing content.
- Do not use the Platform for any unauthorized commercial purpose.
4. Hardware and installation
Vektor Fitness devices (receivers, sensors, Vektor Fitness Box) are provided under sale or loan, per the contract with each Gym. Installation follows the technical guide provided by Vektor Fitness; damage caused by improper installation is not covered under warranty.
5. Intellectual property
All Platform content — including software, source code, layouts, text, images, logos, videos, trademarks, patents and databases — is the exclusive property of JF Tecnologia e Soluções LTDA or licensed to it. Copying, reproducing, modifying, distributing, commercializing, decompiling or otherwise exploiting such content without prior written authorization is forbidden.
6. User content
By submitting photos, messages, metrics or any content to the Platform, the User grants Vektor Fitness a non-exclusive, worldwide, royalty-free license to store, display and process such content strictly to operate the contracted services. The User is solely responsible for content they submit.
7. Limitation of liability
Vektor Fitnessuses its best efforts to keep the Platform operational but does not guarantee uninterrupted availability. The Platform is provided “as is”, with no warranties beyond those required by law. Vektor Fitness is not liable for:
- Damages arising from misuse or violation of these Terms.
- Temporary downtime for scheduled maintenance, announced with reasonable notice.
- Health decisions based on displayed metrics; the Platform does not replace medical or fitness-professional guidance.
- Internet, power or third-party hardware failures outside its control.
8. Health and member responsibility
Heart-rate, calorie and effort metrics displayed by the Platform are estimates, informational and motivational in nature. Before beginning any training program, members should undergo medical evaluation and follow the guidance of the fitness professional in charge.
9. Suspension and termination
Vektor Fitness may suspend or terminate access for Users who violate these Terms, commit fraud, or whose Gym contract is terminated. The User may close their Account at any time by contacting suporte@vektorfitness.com.br.
10. Changes to the Terms
These Terms may be revised periodically. The version in force is always the one published on this page, with the last-update date shown above. Material changes will be communicated with reasonable advance notice, by e-mail or in-app notification.
11. Jurisdiction and governing law
These Terms are governed by the laws of the Federative Republic of Brazil. Any controversy is submitted to the courts of Santa Rita do Sapucaí — MG, Brazil, with waiver of any other jurisdiction however privileged.
